Terms of Service

Dainty operates a marketplace connecting performing artists with event organisers and venues. By creating an account or using dainty.studio, you agree to these Terms. If you do not agree, do not use Dainty.

These Terms apply to all users — artists, venues, organisers, and anyone browsing the platform. Additional terms may apply to specific features such as payment processing, governed by our Stripe agreement.

Artist means any performer, DJ, band, or act that lists their services on Dainty.

Booker means any event organiser, venue, or individual who uses Dainty to request or book Artists.

Engagement means a confirmed booking agreement between an Artist and a Booker facilitated through the Platform.

Platform means dainty.app and any associated mobile applications, APIs, and services.

Service Fee means Dainty's platform fee on Engagements — a fixed amount per charge plus a percentage of the amount collected (see Payments & Fees).

Deal type means how an Engagement is priced: a flat fee, a door split (a share of ticket revenue), or a hybrid guarantee plus share.

You must be at least 18 years old to use Dainty. By using the Platform, you represent that you are of legal age and have the legal capacity to enter into binding contracts in your jurisdiction.

Businesses using Dainty must be duly incorporated and authorised to do business. You are responsible for ensuring your use of the Platform complies with all applicable laws in your territory.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Report any suspected unauthorised access through the app.

You may not create more than one account per person without our prior written consent. We reserve the right to suspend or terminate accounts that violate these Terms.

Artist profiles are publicly visible. By publishing a profile, you grant Dainty a non-exclusive licence to display your profile content to Bookers and in promotional materials for the Platform.

Inquiry: A Booker submits an inquiry specifying event details. No contract exists at this stage.

Quote: The Artist responds with a quote. The quote constitutes an offer.

Acceptance: The Booker selects a package and initiates payment. This constitutes acceptance and creates a binding Engagement.

Confirmation: Dainty confirms payment and issues the digital contract to both parties. The Engagement is now confirmed and a confirmed booking may automatically become a public or private event, optionally with tickets sold through the Platform.

Quotes carry a deal type — flat fee, door split, or guarantee + share — which determines how money is settled (see Payments & Fees). Quotes are confidential to the party they are issued to; Dainty does not publish prices.

Who may book whom: A Booker may be a consumer or a business (organizer or venue), and the booked party may be an Artist, a Venue, or an Organizer. Artists may also book or collaborate with other Artists. Revenue-share deal types (door split, guarantee + share) are available only where the Booker is a business; consumer and artist-to-artist bookings are flat fee. Where a booking involves more than one supply-side party, the split agreed at booking determines each party's share at settlement.

Artists and Bookers are solely responsible for the performance of their obligations under an Engagement. Dainty is a marketplace and not a party to the contract between the parties.

Payments are processed by Stripe (Stripe Payments Europe, Ltd. and, where applicable, Stripe, Inc.). By using payment features you also agree to Stripe's terms. Dainty never holds your money directly: card payments are captured into a platform balance and held until the Engagement completes, then transferred to the Artist's connected Stripe account using Stripe's "separate charges and transfers" model. Dainty is not a bank and does not provide escrow or money-transmission services; it is a technology platform that facilitates payments through Stripe.

Dainty's platform fee is a fixed €1.00 per charge plus 3% of the amount collected. Where an event sells tickets through Dainty, the fee applies per ticket order and to any pre-funded guarantee.

Payment-processing fee: Stripe's own processing fee (a small fixed amount plus a percentage per charge, set by Stripe and varying by card region) is passed through and deducted from the amount collected. It is not a Dainty charge and is not marked up.

How settlement works: both fees come off the top of the total collected before the deal is settled. The remainder is shared according to the agreed deal type — flat fee, door split, or guarantee + share — with each party bearing a proportional share of the fees, so a payout may be slightly below the headline figure.

Payout timing: funds are released to the Artist after the event has ended and any dispute window has passed (typically around 24 hours after the event, absent a dispute). Long-lead bookings may split into a deposit taken now and a balance charged before the event.

All amounts are displayed in the currency shown on the quote. Dainty is not responsible for currency-conversion losses charged by your card issuer.

Cancellation by Booker (tiered by lead time): When a Booker cancels a confirmed Engagement, Dainty's platform fee and the non-recoverable payment-processing fee are retained; the remaining pool is then split between a refund to the Booker and a cancellation fee to the Artist, who reserved the date and may have turned away other work:

• 7 or more days before the event: full refund of the pool; no Artist fee.
• 3 to 7 days before: the Artist receives 50% of the pool.
• 24 to 72 hours before: the Artist receives 75%.
• Under 24 hours: the Artist receives the full pool; no refund.

Only amounts actually collected are refundable — a deposit-only booking is bounded by the deposit, not the full quote.

Cancellation by Artist: If an Artist cancels a confirmed Engagement, the Booker receives a full refund. Repeated cancellations may result in account suspension.

Force Majeure: Neither party is liable for failure to perform due to circumstances beyond their reasonable control, including natural disasters, government orders, or public-health emergencies. Dainty will facilitate a fair resolution on a case-by-case basis.

If something goes wrong with a booking, either party may open a dispute from the booking's contract in the app while the Engagement is confirmed, live, completed, or within its dispute window. Opening a dispute pauses any payout until the matter is resolved.

Disputes are handled confidentially. Each party has a private channel with the Dainty Dispute Team and shares their account and evidence only with the Team — never with the other party. The Team reviews both sides, may ask follow-up questions, and then proposes a resolution (release to the artist, refund to the booker, or a split of the held funds), with a neutral summary to each side.

A proposal takes effect only if both parties accept it. If either party declines, or the matter involves safety, legal, or fraud concerns, exceeds €2,000, or cannot be resolved on the evidence, a Dainty specialist makes a final determination. For amounts of €2,000 or more, a party who disagrees with the determination may refer the matter to the EU Online Dispute Resolution platform or an approved ADR body (see Dispute Resolution). Typical response and decision windows are shown in the app; you have at least 5 days to respond and 3 days to decide on a proposal.

You may not use Dainty to:

• Circumvent the Platform by arranging bookings directly after initial contact through Dainty (first-contact protection: 12 months)
• Post false, misleading, or fraudulent listings
• Harass, threaten, or discriminate against other users
• Scrape, reverse-engineer, or copy Platform content
• Use Dainty to facilitate illegal activities
• Impersonate another person or entity

Violation may result in immediate account termination and legal action.

Dainty hosts user-generated content — profiles, photos, messages, and reviews. We have zero tolerance for objectionable content or abusive behaviour, including harassment, hate speech, threats, spam, impersonation, and sexually explicit or otherwise inappropriate material.

Reviews: Reviews may be left only by people with a genuine connection to what they review — a party to a completed booking, or a ticket holder rating an event they attended. Reviews must be honest and based on first-hand experience; fake, incentivised, retaliatory, or defamatory reviews are prohibited and may be removed. A profile's rating aggregates its booking and attendee reviews, and the reporting and moderation rules below apply equally to reviews.

Reporting: Every profile has a Report control. Tell us what's wrong and, if you wish, block the person at the same time. Reports go to our moderation team, who review within 24 hours and may warn, remove content, or suspend the account responsible.

Blocking: Blocking a user hides their profile and content from you across the Platform and prevents further interaction. You can manage blocks from your privacy settings.

You can also email abuse@dainty.studio at any time. By posting content you confirm you have the right to do so and that it complies with these Terms; we may remove content and terminate accounts that do not.

Dainty and its operator own all intellectual property rights in the Platform, including the Dainty brand, software, design, and content we create.

Content you upload (photos, bios, music samples) remains yours. You grant Dainty a worldwide, royalty-free licence to use, display, and reproduce this content for the purposes of operating and promoting the Platform.

To the maximum extent permitted by law, Dainty's total liability for any claim shall not exceed the greater of (a) €100 or (b) the total service fees paid by you in the 12 months preceding the claim.

Dainty is not liable for loss of profits, loss of data, indirect or consequential damages, or damages arising from your interactions with other users.

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under German law.

These Terms are governed by German law. The place of jurisdiction is Frankfurt am Main, Germany, except where mandatory consumer protection laws in your country grant you the right to bring claims in local courts.

If you are a consumer based in the EU, you may benefit from mandatory protections under the law of your country of habitual residence, which these Terms do not override.

We may update these Terms from time to time. We will notify you of material changes by email at least 14 days before they take effect. Your continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
